Massachusetts Athlete/Member. - “Activities” include all training, drilling, conditioning, sparring, open mats, competitions, seminars, events, and use of facilities/equipment on or off site, including travel to/from events. - “Released Parties” means: Underground MMA Fight Team; (b) Joe Shibley, individually and in any capacity as owner/officer/manager/coach; (c) the premises commonly known as “Bismarck Place,” located at 16 Union Ave, Westfield, MA, including the building owner(s), landlord(s)/lessor(s), property manager(s), and their respective affiliates, members, managers, officers, directors, employees, contractors, volunteers, agents, insurers, successors, and assigns; and (d) instructors, coaches, event organizers, promoters, sponsors, sanctioning bodies, other participants, and any owners/lessors of equipment used. Health Attestation Participant represents they are physically able to engage in a rigorous combat sports program without undue risk, have disclosed relevant conditions, and will not participate while ill, injured, or under the influence. Participant agrees to follow all safety and hygiene rules. Assumption of Risk Participant understands MMA/combat sports involve serious risks, including, without limitation: strikes; grappling, chokeholds, and joint locks; takedowns/falls; concussion and potential long-term effects; head/neck/spinal injuries; loss of consciousness; fractures, sprains/strains, lacerations; cardiac events; dehydration/heat illness; skin and communicable diseases (e.g., staph/MRSA, ringworm, COVID-19); equipment/facility defects; and the acts or omissions of others. These risks exist during all Activities. PARTICIPANT VOLUNTARILY ASSUMES ALL RISKS, KNOWN AND UNKNOWN, INCLUDING THOSE ARISING FROM THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY. Release, Waiver, and Covenant Not to Sue TO THE FULLEST EXTENT PERMITTED BY MASSACHUSETTS LAW, PARTICIPANT RELEASES, WAIVES, AND FOREVER DISCHARGES THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION FOR INJURY, ILLNESS, PROPERTY DAMAGE, OR DEATH ARISING OUT OF OR RELATED TO THE ACTIVITIES, INCLUDING CLAIMS ALLEGING THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY. PARTICIPANT AGREES NOT TO SUE THE RELEASED PARTIES FOR SUCH CLAIMS. This does not waive claims that cannot legally be waived (e.g., gross negligence or willful/reckless misconduct where prohibited). Indemnification and Hold Harmless Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) brought by Participant or any third party arising out of Participant’s participation, breach of this agreement, or negligent/intentional acts. If minors train, include a parent/guardian consent and indemnity; Massachusetts may limit releases on behalf of minors. Rules; Right to Refuse; Medical Authorization Participant will follow all rules/instructions. The Released Parties may refuse or revoke participation for unsafe behavior or rule violations without refund. In an emergency, Participant authorizes first aid and medical treatment reasonably deemed necessary and accepts responsibility for all related costs. Personal Property Participant is responsible for personal property; the Released Parties are not liable for loss, theft, or damage. Severability; Acknowledgment If any provision is invalid, the remainder remains enforceable and may be modified to the minimum extent necessary to be valid.
